1. Our Service
A. TVDeck (referred to as the "Service" in this document) is a website owned and operated by TVDeck, LLC. The service allows users to view headlines on topics ranging from A-Z in which the site redirects users to a destination based upon a selected feed from a user.
B. Users can create a personalized page referred to as "MyTVDeck" of their favorite "feeds" making it easier to view only headlines a particular user wishes to.
Use of the Service
A. TVDeck is to be used for personal and non-commercial use, given that you "the user" agrees to abide by the terms governing this service. If you don't wish to comply with the terms of use and policies governing the service, simply do not use the service.
B. A user may not use the service in any way that violates applicable laws including, but not limited to local, state, and federal laws.
C. At any point, the service, may or may not allow users to add their own hand picked feeds. Any user that chooses to add their own feeds, must only add content that is free of any illegal acts. Users may not add adult content feeds. At any point, without prior notice, a users account may be shut down, IP address blocked, or feeds may be removed from a users MyTVDeck account.
D. The service reserves any and all rights regarding banning certain users from the site.
E. Users should protect their private information such as their password and user name and not share it with anyone.
F. By signing up for a account, you are confirming that you have knowledge that your MyTVDeck page is publicly visible and all the feeds are as well.
Content
A. As the service does not produce any of the content shown in the "feeds" available through the service, the service has no control over the accuracy, ethical or moral standards of the content. The service does not endorse, review, approve, or moderate any content. YOU SHOULD BE SKEPTICAL ABOUT ANY AND ALL CONTENT VIEWED AT THE END DESTINATION WEBSITE.
B. You agree not to circumvent any and all ways to override the security features of the service in order for personal gain, benefit or satisfaction.
C. Should users be allowed to add feeds of their choosing to their own account, users are not allowed to add any feeds that are demeaning, illegal, or related to adult content. The service always reserves the right to delete and feeds at any time.
COPYRIGHT POLICY
TVDeck respects intellectual property rights and if you would like to make a copyright claim, you may do so by contacting us at admin @ tvdeck.com. If you believe your content is being used in a way that constitutes copyright infringement, please send along the following information with your claim: a) a physical or electronic signature of the person that holds the copyright ownership or the person who has the right to act on their behalf. b) identification of the copyrighted work claim to be infringed upon. c) a statement of good faith belief, that the use of the copyright materials described in the notice that is allegedly infringing, is not authorized by the copyright owner, it's agent, or the law. d) an email address to contact. e) a statement that the information in the notice is accurate, and under the penalty of perjury, the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Limitation of Liability:
You agree that TVDeck, LLC shall not be liable to you for:
- a) any and all direct or indirect damages that may occur out of the use of the service.
- b) inability for the company to maintain your accounts accuracy.
- c) any transaction between you and an advertiser or sponsor of the site.
- d) failure to keep account information confidential and/or secure.
Indemnification
You agree to indemnify and hold TVDeck, LLC harmless from any claims, losses or damages, including legal fees, resulting from your violation of these Terms of Use, your use of this Service.
Service available - "AS-IS"
Your access to the service or any content in relation to using the service, is at your own risk. You understand that the service is "as is" and "an available" basis. The service makes no warranty and disclaim all responsibility and liability for the completeness, accuracy, availability, timeliness, security or reliability or the services or any content in relation. The company is not responsible for any harm that may result to your computer system, loss of data, or other harm that may result from use of the service. There is no warranty that the service will be error-free, secure, or uninterrupted.
Exclusions
Some local laws may not allow parts of these terms to apply to you. In that case, those terms need not apply to you.
Controlling Law and Jurisdiction
These terms and actions related to this agreement, are governed by the laws in the State of Wisconsin, without regard to conflicting laws of your state, country or place of residence. All claims and/or legal proceedings or litigation arising from this service, will be brought solely in Milwaukee County, in the State of Wisconsin.
No Waiver
The failure of TVDeck, LLC to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. In the event that any provision of these terms is held to be invalid or unenforceable, the remaining provisions of these terms will remain in full force and effect.
Changes
These terms of service may change at any time, without prior notice. It is your responsibility to check back frequently, to be up to date with the latest policies. After new terms are published, you agree to abide by these terms effective immediately.
